Marietta Bench Warrants Lookup

Marietta bench warrants are processed through the Cobb County Sheriff's Office. As the county seat of Cobb County, Marietta is where the main courthouse and sheriff's office are located. When someone misses a court date for a Marietta case, the judge issues a bench warrant and the Cobb County Sheriff handles the rest. Cobb County has a dedicated Warrant Division that you can reach at 770-528-8900. There is no online tool to look up active bench warrants in Marietta.

Cobb County Sheriff and Marietta Warrants

Sheriff Craig Owens runs the Cobb County Sheriff's Office. His team handles all bench warrants for Marietta and the rest of Cobb County. The Warrant Division is a dedicated unit that processes new warrants as soon as courts issue them. Each warrant gets entered into the county database, the Georgia Crime Information Center, and the NCIC system. Once logged, an active Marietta bench warrant is visible to law enforcement nationwide. The sheriff's main office is at 185 Roswell Street in Marietta, right next to the Cobb County courthouse.

Cobb County has a separate Warrant Division phone line at 770-528-8900. This is the best number to call for general questions about the warrant process. Staff may be able to answer basic questions about how things work, but they will not confirm or deny a specific warrant over the phone. For a formal warrant check, you need to show up in person with a photo ID.

The general sheriff's office number is 770-499-4611. That line handles all types of sheriff business, not just warrants.

Marietta Police Department

The Marietta Police Department is at 240 Lemon Street. It handles local law enforcement within the city limits. Officers respond to calls, patrol neighborhoods, and make arrests. During traffic stops or other police encounters, Marietta officers run names through the state database. If a bench warrant shows up, the officer can arrest you on the spot.

The police department does not run a warrant inquiry desk for the public. If you call and ask about a bench warrant, they will send you to the Cobb County Sheriff's Warrant Division instead. The two agencies work together, but the sheriff is the one who officially tracks and serves bench warrants in Cobb County.

Searching for Bench Warrants in Marietta

Since Marietta is the county seat, the Cobb County Courthouse is right in town. You can walk into the courthouse on Roswell Street and ask at the Warrant Division about your status. Bring a government photo ID. Staff will look up your name and tell you if there is an active bench warrant. They will also share the charge and the case number. Be aware that if a bench warrant exists, law enforcement may take you into custody at that point.

Cobb County does not offer an online search for outstanding bench warrants. The jail roster on the sheriff's website shows current inmates only. It does not list people with active warrants who have not been picked up. The Georgia.gov warrant search guide explains the statewide process for checking warrants. It applies in Cobb County just like everywhere else in Georgia.

Many Marietta residents hire a lawyer before going to the courthouse. An attorney can file a motion to recall the bench warrant. If the judge grants it, you get a new court date without being taken into custody. This is the safest path if you think there might be a bench warrant out for you. The Georgia Courts sheriff directory lists every sheriff in the state, including Cobb County, with full contact details.

Marietta Bench Warrant Penalties

Skipping a court date in Marietta creates real problems. Under O.C.G.A. 16-10-51, bail jumping on a misdemeanor carries up to 12 months in jail and a $1,000 fine. Felony bail jumping means one to five years in prison and up to $5,000 in fines. These penalties stack on top of the original charge. A bench warrant is its own offense.

Traffic cases have different rules. O.C.G.A. 40-13-63 says failing to appear for a traffic hearing can result in a $200 fine and up to three days in jail. The court can also ask the Georgia Department of Driver Services to suspend your license under O.C.G.A. 40-5-56. Getting the license back costs $100 at a DDS office or $125 by mail. That is a separate fee from anything you owe the Marietta court.

Under O.C.G.A. 17-6-11, the court clerk must mail a notice letter and wait 30 days before certain bench warrants go active. This 30-day window applies to traffic cases. If you respond within that time frame, the court may not issue the warrant at all. After the deadline, the bench warrant enters the system and has no expiration date.

Note: Cobb County bench warrants stay active until resolved, so a Marietta warrant from years ago can still lead to arrest today.

Marietta Warrant Records and Resources

Georgia's Open Records Act under O.C.G.A. 50-18-70 gives you the right to request court records from government offices. Bench warrant files from Marietta cases are part of the Cobb County court system. You can ask the Cobb County Clerk of Superior Court for case details. Requests work in person or in writing.

The Georgia Sheriffs' Association directory and the Georgia Bureau of Investigation both provide useful contacts for people dealing with bench warrants. The GBI runs the statewide criminal database, and the sheriffs' association lists every county sheriff with phone numbers and addresses.
